These Terms of Service ("Terms") govern your access to and use of SipEvo (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
The Service is designed for two primary user types: businesses utilizing our software ("Venues") and guests interacting with digital menus ("Tasters").
1. Age Requirement
The Service is intended to facilitate the review of alcoholic and non-alcoholic beverages. You must be of legal drinking age in your jurisdiction (e.g., 18 years of age or older in Australia) to participate in tasting sessions and use the Service as a Taster. By accessing the Service, participating in a tasting session, or submitting feedback, you warrant that you meet this age requirement.
2. Nature of the Service
SipEvo provides a software platform for venues to display digital menus and collect feedback. We are a technology provider; we do not manufacture, sell, distribute, or serve alcoholic beverages. The Venue is solely responsible for the Responsible Service of Alcohol (RSA) and compliance with all local liquor licensing laws.
3. Taster (Guest) Terms
If you are accessing the Service as a Taster:
- Guest Access: You can access the digital tasting list and submit feedback anonymously (via a temporary browser session) or by providing a valid email address. If you participate anonymously, session data is stored locally. You can later choose to link the session to an email address to save it to your Tasting Journal.
- Acceptable Use: You agree that any ratings or reviews you submit will be honest, respectful, and related to the products tasted. You may not submit content that is offensive, discriminatory, defamatory, or constitutes spam.
- Content Ownership & License: By submitting a review or rating (on our 0.0 to 5.0 scale represented by custom drink-glass icons), you grant SipEvo and the visited Venue a non-exclusive, royalty-free, perpetual, and sublicensable license to use, display, analyze, and process your feedback. We reserve the right to remove any review that violates these Terms.
4. Venue (Business) Terms
If you are registering an account on behalf of a Venue:
- Account Responsibility: You are responsible for maintaining the security of your administrator and staff accounts.
- Subscriptions & Payments: Access to certain features requires a paid subscription. We offer three tiers: Free Setup ($0/mo), Standard Pro ($59/mo), and Hibernation ($10/mo). Standard Pro enables live tasting mats and analytics. Hibernation disables live mats but retains analytics access. Canceled accounts retain read-only analytics access. All billing is in advance on a recurring monthly basis via Stripe.
- Data Privacy Compliance: You acknowledge that you will receive access to Taster email addresses and tasting feedback. You agree to comply with all applicable privacy and anti-spam laws (e.g., the Australian Privacy Act 1988 and Spam Act 2003) regarding how you contact these Tasters outside of the SipEvo platform.
- Accuracy: You are responsible for the accuracy of the product details (e.g., ABV, style, tasting notes, pricing) displayed on your digital tasting lists.
5. Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, SipEvo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, resulting from:
- Your access to or use of the Service.
- Any conduct or content of any third party on the Service.
- Any actions taken by Venues regarding the physical service of alcohol.
6. Modifications to the Service
We reserve the right to modify or discontinue the Service with or without notice. We may also update these Terms. Your continued use of the Service after any changes indicates your acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia.
